[Chapter 1 - Regulation] Article 1 Purpose The terms and conditions apply to the use of the KMI foundation website service and specify the user¡¯s entitlements and responsibilities. Article 2 The terms used in the terms and conditions are as follows. (1) "Site" refers to the virtual space provided by KMI using computer information network. (2) "Service" refers to the KMI website and internet service provided by KMI. (3) "member (user)" refers to the subjects receiving the service and the user using the services provided by KMI. (4) "Administrator" refers to the control personnel chosen by the KMI who is monitoring and controlling the service and operations. (5) "ID" refers to the login identification verified at the login process to KMI website and it is consisted of 4-15 characters of English alphabets and numbers combination. (6) "password" refers to the member¡¯s identification verification means and confirmation of the personal information and personal privacy. For the security of the personal information and privacy, password of English alphabet and number combination is to be chosen by the member and approved by the company. (7) "personal information" refers to the gathered information of name, resident registration number and person¡¯s specific identification information to verify the member to be the actual personal information holder. (8) members are categorized as general member, VIP member and administrator, and each member holds the following authorities. - General member : A subject approved as a member of the KMI foundation through KMI online membership application acceptance, who does not use personal medical information service provided by internet. - VIP member: A subject approved as a member of the KMI foundation via KMI website, who can use the center¡¯s internet information service. This member has authority to use the various medical information service provided by KMI such as the medical health check up appointment application, appointment result search, and medical procedure result search. There may be limitations on information disclosure by the KMI policy. - administrator : The high authority ID given to the administration personnel for the purpose of the center internet website control and monitoring. Each administrator has authority and power of controlling and monitoring the website within the given authority levels. (9) For the purpose of personal privacy policy, member¡¯s resident registration number is to be saved as a code so that it is not to be duplicated. Personal information is not to be released or used other than for the inevitable purpose of personal verification and medical service changes. Article 3 Amendment and disclosure of terms and conditions (1) The terms and conditions become effective when KMI notifies on the service page or notifies to the members via any other means. (2) KMI may amend the terms and conditions in unavoidable circumstances unless the amendments are illegal. (3) KMI may amend the terms and conditions in unavoidable circumstances or reasons for business importance and the amended terms and conditions become effective when notified by the means specified in the previous section or upon notifications. (4) Matters that are not specified by the terms and conditions or the interpretation of the terms and conditions follow the related legislations or the common law. Article 4 service content and changes (1) KMI provides the following service. a. The general guide service provided by KMI. b. Outpatient related appointment and medical service. c. Other services authorized by KMI (2) KMI may amend the service content in unavoidable circumstances. In this case, the amended service content and the date of amendment are to be specified and notified via the service page or to be notified to the members via any other means. (3) KMI do not hold any responsibilities on damages occurred to the users due to KMI service content amendments, unless KMI has deliberate reason to make such amendments or KMI is considered to be at fault. Article 5 cessation of the services (1) KMI service may temporarily be limited or ceased due to systemic service, maintenance, errors, temporary network disability, service improvement, systemic regular check up, and emergency. (2) KMI is not liable for reparation of damages occurred to the user and the 3rd party due to the temporary service provision cessation specified in the section 1 unless KMI has deliberations or KMI is considered to be at fault. [Chapter 2 - membership join and cancellation] Article 6 : Membership (1) User may apply for membership via the membership approval process provided by KMI. Membership application requires agreement to the terms and conditions. (2) KMI acknowledges subjects as a member, who apply for a membership as specified in the previous sections, unless the following conditions apply. a. Membership application is lodged under someone else¡¯s name b. subjects who had a membership cancellation previously according to section 2 or section 3 of the article 7 of the terms and conditions agreement c. In the case of membership application with faulty information, omission of the content or error in the provided information. (3) The membership application approval date is effective on or after the date the approval by KMI. (4) In the case of personal information changes occur, the member is required to notify the head branch center via internet or phone. Article 7 Membership cancellation or disqualification (1) A member may ask for a membership cancellation at any time and KMI is to process the membership cancellation upon the request. The membership cancellation request is only to be submitted via internet and personal verification process is required for the cancellation process in order to follow personal privacy policy. Upon the membership cancellation, all information except for the ID is to be abolished. However, if the subject is a patient of our medical center, the medical related information is not to be deleted and is to be kept for a record. (2) A member is subjected to disqualification by KMI in the following cases. a. If the provided member information is faulty. b. In the case of disturbance to other member¡¯s service use or in the case of illegal use of the information or in the case of threatening the rules and regulations of the service operations. c. In the case of information disclosure to the 3rd party without the approval of KMI unless the service information is used for the purpose of the member¡¯s personal use. d. In the case of making changes to the information provided by KMI or in the case of the website operational disturbance e. In the case considered inappropriate for membership maintenance for other reasons. (3) After making an appointment via the KMI internet website and cancelling the appointment without reasonable causes more than 3 times or in the case of payment in arrears, the internet medical appointment service is limited for a period of 1 year. Article 8 Reapplying for membership (1) In the case of previous membership cancellation according to the section 7 of the terms and conditions agreement, the subject may reapply for a membership according to the section 6 of the terms and conditions. (2) If reapplying for a membership, the previous internet medical appointment service record is to be continued from the previous record that was held in the previous membership record according to the item 3 of the section 7 of the terms and conditions agreement. [Chapter 3] Personal privacy protection Article 9 Gathering of personal information (1) KMI may gather the user¡¯s personal information for the purpose of service provision and application. (2) Unless applicable to the following cases, the user¡¯s approval is to be sought in case of personal information gathering. a. In the case against legal legislations b. In the case of service use contract operations (3) KMI is responsible for technical support and management to protect against personal information disclosure and manipulation. (4) The provided personal information is not to be used other than the original purpose without the subject¡¯s approval or is not to be released to the 3rd party. a. In the case against legal legislations b. User verification process c. If required for payment of the service provision and service delivery. d. If required for KMI website operational use or for a use in statistical analysis e. For the purpose of statistical analysis, research and development and market research, the personal information may be released in the anonymous form of unidentifiable data. [Chapter 4] Responsibility limitations on internet medical appointment service Article 10 medical appointment application and completion (1) User may make an appointment according to the method specified in the website a. Enter the required details of ID, password, name, address, and phone number b. select the medical procedure program, consultation date and desired date of medical appointment. c. Indication as to agree to the terms and conditions (2) KMI gives approval on appointment applications of Item 1 unless any of the followings is applicable. a. The application has faulty information, omission of information or errors b. In the case of technical difficulty with appointment application approval. c. In the case of internet medical appointment application is not possible due to the difficulty with providing the medical service by a particular physicians or the nature of the medical procedural difficulty based on the KMI policy. (3) The user is required to agree on the following terms and conditions if an appointment is made via internet. a. The KMI is the 3rd medical institute and requires referrals or medical health check up procedure results issued by the 1st or 2nd medical institutes (hospitals, physicians) in order to receive benefits of national health insurance and the referral should be within the 7days from the issued date. b. Any amendments and cancellations of the medical appointment made via the internet is limited to the internet appointments of complete process. c. In the case of internet medical appointments, if there exist a payment in arrears any amendments or cancellations are approved within 3days from the date of the appointment. [Chapter 5] KMI and User responsibilities Article 11 KMI¡¯s responsibilities (1) KMI has responsible of providing stable service according to the terms and conditions unless there exists an inevitable circumstances such as system maintenance, development, and network problems. (2) KMI is responsible for the protection of the personal privacy following the personal privacy policy and this includes the user¡¯s credit information. (3) Members have the right to access to personal information and has right to request rectifications on faulty information to the information managing administrator. (4) KMI is not to send out promotional emails of profit making purpose unless the user agrees to receive them. Article 12 User responsibilities (1) The user is not to do any of the followings. a. Registration of faulty information when the user is making applications or amendments. b. Illegal use of other person¡¯s resident registration number or password other than the user¡¯s own. c. Making amendments on the information provided on the website. d. Illegal use of the member¡¯s personal information acquired from the service through copying, amendments, translation and plagiarism in order to copy, public disclosure, media disclosure, exhibition and publications. e. An act of defamation or an act of taking advantages of others. f. An act of violation of KMI¡¯s publication rights and that of the 3rd party¡¯s. g. Distribution of illegal information, sentences, diagrams, and voices and any form of illegal distribution of information to others. h. Any acts that is related to illegal acts. i. Any act of causing technical problems to the network or operations and any act of circulating and registering computer virus that may cause destruction or confusion to the service provision. j. An act of sending out information that may be disturbing the stability of the service operation or an act of sending out promotional information against the person¡¯s will. k. Any other acts of illegal nature. (2) The user has duties of the followings in terms of ID and password use. a. The user is to utilize ID and password when KMI service is used. b. The user is liable for the use of his/her own use of the ID and password. c. The user is not to release his/her ID and password to the 3rd party. d. The user is responsible for the misuse of his/her ID and password. e. In case of ID and password theft or in case of noticing the illegal use of the ID and password by the 3rd party, the user is to notify KMI at once and to follow the instructions given by KMI. [Chapter 6] other terms and conditions Article 13 Publication rights and the use limits (1) KMI holds all the publication rights of any publications produced by KMI and the publication related profts. (2) The user is not to make profits from using the information on the KMI website by copying, transfer, publication, distribution, media disclosure and by any other means and the user is not to disclose the information to the 3rd party unless KMI authorizes such acts. Article 14 resolution of dispute (1) KMI and the user are responsible for a prompt resolution of any dispute and are required to take necessary acts with efforts. (2) KMI takes complaints and suggestions from the user and takes priority in resolving the matters. If there exists a problem with a prompt process in the problem solving, the user is to be notified of the reasons and the process of the matter. Article 15 Jurisdiction and legislations (1) In the case of legal dispute between the user and KMI, the lawsuit is to be dealt by the competent court of KMI address. (2) The national law of republic of Korea is applicable to the lawsuit between the user and KMI.
